Službu Bonasea prevádzkuje Noosa s. r. o., Nevská 8392/6, 841 06 Bratislava, IČO 51212242. Používaním aplikácie súhlasíš s týmito podmienkami.
1. Služba
Bonasea poskytuje plánovanie plavieb podľa predpovede vĺn a počasia, informácie o hĺbkach a prekážkach a navigačnú pomôcku využívajúcu polohu zariadenia. Službu môžeme vyvíjať, meniť alebo jej časti ukončiť; o podstatných zmenách informujeme v aplikácii.
2. Účet
Účet je určený pre jednu osobu; za činnosť pod tvojím účtom zodpovedáš ty. Účet môžeš kedykoľvek zrušiť priamo v aplikácii (Nastavenia → Účet → Zrušiť účet), a ak sa nevieš prihlásiť, žiadosťou na noosa.sro@gmail.com; postup a čo sa pri tom zmaže, nájdeš na /delete-account. Účty zneužívajúce službu (útoky, automatizované sťahovanie dát, obchádzanie limitov) môžeme zablokovať.
3. Plány a nákupy
Plány. V aplikácii pre Android a iPhone si môžeš kúpiť plán Weekly (7 dní), Charter (14 dní) alebo predplatné Pro (1 rok). Mimo USA ponúkame trojdňovú skúšku zadarmo bez platobnej karty – raz pre účet a raz pre zariadenie, len pre účet, ktorý ešte nič nekúpil; v USA bezplatný plán Free s mapami USA a s limitmi na uložené položky. Čo ktorý plán obsahuje a koľko stojí, vidíš v aplikácii (Účet → Plány) pred nákupom; cenu v tvojej mene určuje obchod podľa tvojej krajiny. Plán platí na tvojom účte vo všetkých zariadeniach aj na webe app.bonasea.com.
Nákup a platba. Nákupy prebiehajú len cez Google Play alebo App Store; platbu, doklad o nákupe a obnovovanie predplatného spravuje obchod podľa svojich podmienok, platobné údaje k nám neprichádzajú. Plán kúpený počas bežiaceho obdobia začne po jeho skončení; Pro začne hneď a zvyšok bežiaceho plánu prepadne. Počas predplatného Pro sa plán na obdobie kúpiť nedá.
Predplatné Pro sa obnovuje automaticky každý rok za cenu platnú v obchode, kým ho nezrušíš v nastaveniach predplatných v Google Play alebo App Store, najneskôr 24 hodín pred koncom obdobia. Zrušenie platí od konca zaplateného obdobia. O zmene ceny ťa vopred upovedomí obchod podľa svojich pravidiel.
Digitálny obsah a odstúpenie od zmluvy. Plány sú digitálny obsah, ktorý ti sprístupníme hneď po zaplatení. Kúpou výslovne súhlasíš so začatím plnenia pred uplynutím 14-dňovej lehoty na odstúpenie od zmluvy a berieš na vedomie, že tým právo na odstúpenie strácaš. Vrátenie peňazí rieši obchod svojím postupom; ak obchod nákup vráti alebo zruší, plán skončí.
Po skončení plánu ti zostane účet, trasy, lode a lodný denník – prezrieš si ho a uložíš aj plavbu, ktorú aplikácia už zaznamenala; plánovanie a navigácia sa vrátia s ďalším plánom. Pri skončení plánu sa nič z tvojich dát nemaže a bežiaca kotviaca stráž sa nevypne.
Zmeny. Ponuku a ceny plánov môžeme meniť; zmena sa nedotkne už zaplateného obdobia.
4. Tvoj obsah
Trasy, lode a miesta, ktoré vytvoríš, ostávajú tvoje. Udeľuješ nám len právo ich ukladať a spracúvať v rozsahu potrebnom na poskytovanie služby.
Komunitné miesta. Recenzie, hodnotenia a fotografie, ktoré zverejníš pri komunitných miestach, ostávajú tvoje; udeľuješ Noosa s. r. o. nevýhradnú, bezodplatnú a územne neobmedzenú licenciu ich ukladať, zmenšovať, zobrazovať a sprístupňovať ostatným používateľom v rámci služby, kým ich sám nezmažeš alebo nezrušíš účet – vtedy sa odstránia aj s fotografiami. Pri recenzii sa zobrazuje tvoje verejné meno, ak ju nezverejníš bez mena. Miesta, ktoré pridáš (názov, druh a poloha), zostávajú v službe aj po zrušení účtu, už bez údaju o tom, kto ich pridal. Zverejňuj len to, čo si sám vytvoril alebo máš právo zverejniť, bez osobných údajov iných ľudí (tváre, mená, evidenčné čísla lodí), bez urážok a reklamy. Fotografie zverejňujeme až po kontrole; obsah, ktorý porušuje tieto pravidlá alebo ktorý nahlásia iní používatelia, môžeme skryť alebo odstrániť a účtu odobrať možnosť prispievať. Recenziu alebo fotografiu, ktorú nahlásia dvaja používatelia, a miesto, ktoré nahlásia traja, skryjeme automaticky, kým ich neposúdime; nahlásenie od autora obsahu sa nepočíta. Nahlásiť obsah (aj fotografiu) a skryť si autora (aj pri recenzii bez mena) môžeš priamo v aplikácii.
5. Dáta tretích strán

Ich licencie a podmienky sa vzťahujú aj na teba pri ďalšom použití týchto dát.
6. Zodpovednosť
Službu poskytujeme „tak, ako je". V rozsahu, aký dovoľuje právo, nezodpovedáme za škody vzniknuté použitím alebo nedostupnosťou služby, nepresnosťou dát alebo rozhodnutiami prijatými na ich základe. Nič v týchto podmienkach neobmedzuje práva spotrebiteľa podľa kogentných predpisov.
Bezpečnostné funkcie. Kotviaca stráž, navigačné upozornenia a živé zdieľanie polohy sú pomôcky. Závisia od tvojho zariadenia, jeho operačného systému a nastavení, batérie a dostupnosti signálu GPS a siete – teda od vecí, ktoré nemáme pod kontrolou – a môžu zlyhať aj bez varovania. Známe obmedzenia kotviacej stráže opisujeme na /safety a priamo v aplikácii pri jej zapnutí. Povinnosť riadnej hliadky, správneho kotvenia a rozhodovania podľa dobrej námorníckej praxe zostáva na kapitánovi; tieto funkcie ju dopĺňajú, nenahrádzajú. Obmedzenia zodpovednosti v tomto článku sa nevzťahujú na škodu spôsobenú úmyselne alebo z hrubej nedbanlivosti, na ujmu na živote alebo zdraví ani na zodpovednosť, ktorú právo vylúčiť alebo obmedziť nedovoľuje (napríklad za škodu spôsobenú vadným výrobkom) – tú nevylučujeme ani neobmedzujeme.
7. Právo a spory
Podmienky sa riadia právom Slovenskej republiky. Spory riešia príslušné súdy SR; spotrebiteľ môže využiť aj alternatívne riešenie sporov.
8. Podpora
Píš na support@bonasea.com. Odpovedáme po anglicky; napísať nám môžeš v ktoromkoľvek jazyku, preložíme si to. Odpoveď dostaneš najneskôr do 2 pracovných dní. Proti zásahu moderátora (skrytá recenzia alebo fotografia, odobratá možnosť prispievať) sa môžeš odvolať e-mailom na tú istú adresu; posúdime ho znova do 7 dní. Ak si predplatné kúpiš cez Google Play alebo App Store, vrátenie peňazí rieši obchod svojím postupom.

Bonasea is operated by Noosa s. r. o., Nevská 8392/6, 841 06 Bratislava, Slovakia, company ID (IČO) 51212242. By using the app you agree to these terms.
1. Service
Cruise planning based on wave and weather forecasts, depth and hazard information and a location-based navigation aid. We may change, develop or discontinue parts of the service; material changes are announced in the app.
2. Account
One account per person; you are responsible for activity under your account. You may delete your account at any time directly in the app (Settings → Account → Delete account), or, if you cannot sign in, by writing to noosa.sro@gmail.com; the steps and what is deleted are on /delete-account. Accounts abusing the service (attacks, bulk data extraction, circumventing limits) may be blocked.
3. Plans and purchases
Plans. In the app for Android and iPhone you can buy a Weekly plan (7 days), a Charter plan (14 days) or a Pro subscription (1 year). Outside the USA we offer a free three-day trial without a payment card – once per account and once per device, only for an account that has not bought anything yet; in the USA a free Free plan with US maps and limits on saved items. What each plan contains and what it costs is shown in the app (Account → Plans) before you buy; the price in your currency is set by the store for your country. A plan applies to your account on all your devices and on the web at app.bonasea.com.
Purchase and payment. Purchases are made only through Google Play or the App Store; the payment, the receipt and the renewal of the subscription are handled by the store under its own terms, and no payment details reach us. A plan bought during a running period starts when that period ends; Pro starts at once and the rest of the running plan lapses. A period plan cannot be bought while a Pro subscription runs.
The Pro subscription renews automatically every year at the price valid in the store until you cancel it in the subscription settings of Google Play or the App Store, at least 24 hours before the end of the period. A cancellation takes effect at the end of the paid period. The store tells you about a price change in advance under its own rules.
Digital content and withdrawal. Plans are digital content that we make available as soon as you pay. By buying, you expressly agree that performance begins before the 14-day withdrawal period ends, and you acknowledge that you thereby lose your right of withdrawal. Refunds are handled by the store under its own procedure; if the store refunds or cancels a purchase, the plan ends.
When a plan ends you keep your account, routes, boats and logbook – you can view it and also save a passage the app has already recorded; planning and navigation return with the next plan. Nothing of your data is deleted when a plan ends, and a running anchor watch is not switched off.
Changes. We may change the plans on offer and their prices; a change does not affect a period already paid for.
4. Your content
Routes, boats and places you create remain yours; you grant us only the right to store and process them to provide the service.
Community places. Reviews, ratings and photographs you publish at community places remain yours; you grant Noosa s. r. o. a non-exclusive, royalty-free, worldwide licence to store, resize, display and make them available to other users within the service until you delete them or your account, at which point they are removed together with the photographs. A review shows your public name unless you publish it without a name. Places you add (name, kind and position) remain in the service after your account is deleted, without any record of who added them. Publish only what you created or have the right to publish, without other people's personal data (faces, names, boat registrations), insults or advertising. Photographs are published after review; content that breaks these rules or is reported by other users may be hidden or removed and the account barred from contributing. A review or photograph reported by two users, and a place reported by three, is hidden automatically until we have reviewed it; a report by the content's own author does not count. You can report content (photographs included) and hide an author (also of a review without a name) directly in the app.

6. Liability
The service is provided "as is". To the extent permitted by law we are not liable for damages arising from its use or unavailability, data inaccuracies or decisions based on them. Mandatory consumer rights are not affected.
Safety features. The anchor watch, navigation alerts and live position sharing are aids. They depend on your device, its operating system and settings, its battery and the availability of GPS and network signal – things beyond our control – and they can fail, also without warning. The known limits of the anchor watch are described on /safety and in the app when you arm it. The duty to keep a proper watch, to anchor properly and to decide according to good seamanship stays with the skipper; these features supplement it, they do not replace it. The limitations of liability in this section do not apply to damage caused intentionally or by gross negligence, to injury to life or health, or to liability the law does not allow to be excluded or limited (such as liability for a defective product) – we neither exclude nor limit liability for those.
7. Law
Slovak law applies; disputes are heard by the competent Slovak courts (consumers may also use alternative dispute resolution).
8. Support
Write to support@bonasea.com. We answer in English; you may write to us in any language, we will translate it. You get an answer within 2 working days. A moderator's decision (a hidden review or photo, the right to contribute taken away) can be appealed by e-mail to the same address; we examine it again within 7 days. If you buy a subscription through Google Play or the App Store, refunds are handled by the store under its own procedure.
